The Texas seller's disclosure form and its legal basis

What the Texas Seller's Disclosure Notice Asks of Montebello Sellers

Updated November 2026

What does Texas require me to disclose when I sell my house in Montebello?

In October 2026, the Seller's Disclosure Notice, required of sellers of previously occupied single family residences, covers Section 5.008's material facts and the property's physical condition.

What does the Texas Seller's Disclosure Notice ask a seller to disclose?

The Texas Real Estate Commission's form page for the Seller's Disclosure Notice, Form ID 55-1, names who uses it. The form is required by sellers of previously occupied single family residences, alongside a sale contract entered into on or after September 1, 2023.

The same TREC page says the form contains information required to be disclosed by Section 5.008 of the Texas Property Code. That information concerns material facts and the physical condition of the property.

A TREC staff article on form changes after the 88th Texas Legislative Session records one addition. It says HB 697 updates the Seller's Disclosure Notice required under section 5.008. According to that article, the bill adds language requiring a seller to disclose the type of gas fuel piping used in a home.

The same staff article says the BLC recommended that the Commission adopt the changes to the notice, which it calls TREC OP-H. It adds that, if adopted on an emergency basis, the notice would become effective September 1.

This disclosure form is required by sellers of previously occupied single family residences and is to be used in conjunction with a contract for the sale of real property entered into on or after September 1, 2023.

How does a Montebello home line up with the form's wording?

Montebello is a 30-story condominium tower at 1100 Uptown Park Boulevard, with 98 homes and four to each floor. Each home is a unit in an association-governed building.

TREC's form page ties the requirement to sellers of previously occupied single family residences. Before you list, ask your agent to confirm in writing how that wording applies to your unit, and keep the answer with the listing file.

Whatever form you sign, its condition answers and the listing description should match. A buyer's agent reads both. A mismatch tends to surface during the option period, the short window in a Texas contract when a buyer can walk away.

Which Montebello records should sit beside the disclosure when you list?

Start with the association's resale certificate. It states the home's own periodic assessment, any unpaid amounts due from the seller, and every fee payable when ownership transfers. The association has ten days after a written request to furnish one, and may charge up to $375. It must have been prepared no earlier than three months before it reaches a buyer.

The declaration was filed with the Harris County Clerk on 22 March 2002 under file number V678674. Seven further condominium instruments follow it, the last recorded as RP-2018-106990 in March 2018. The association filed its management certificate as RP-2026-58595 on 17 February 2026. Anyone can look up either instrument by its number.

Pull the home's appraisal account too. Its recorded floor area is the figure a buyer's appraiser works from and the figure the assessment moves with. Quote that same figure in the listing.

Questions & answers

Montebello questions, answered

Which version of the Seller's Disclosure Notice should I use for my Montebello sale?

Check the Texas Real Estate Commission's own form page on the day you sign. That page lists the Seller's Disclosure Notice as Form ID 55-1. A staff article TREC published about the 88th session's contract changes calls the same notice TREC OP-H. Two labels for one notice is a good reason to confirm which version your agent hands you, and to read the identifier printed on its face.

Forms change when the statute behind them changes, and a seller's answers are only as current as the form they sit on. Ask for the version identifier and its date in writing. Keep a copy with your listing file, beside the resale certificate. Where your agent's copy and TREC's page disagree, use the one on TREC's page and ask why the other was offered.

Does the disclosure notice ask about my Montebello assessment?

The Texas Real Estate Research Center notes that the Seller's Disclosure Notice carries a disclosure of POA maintenance fees and assessments. At Montebello the operator's building record publishes a rate of $1.05 per square foot each month, so a 5,000 square foot home carries $5,250. Your own figure comes from the resale certificate, so match the notice to the certificate before a buyer compares them.

A buyer compares carrying cost across towers, and the published measure lets them do it: $1.05 per square foot here against $1.15 at The Huntingdon on Kirby Drive. The two fees cover different things. Montebello's includes cable television and an activities manager, and The Huntingdon's includes a courtesy patrol and partial utilities. Carrying cost also weighs on the asking price. Three closings in the trailing twelve months published marketing periods of 16, 55 and 169 days. A monthly figure that matches on every document keeps a buyer's questions on the home rather than on the paperwork.

Should I keep a record of remodelling work when I fill out the disclosure for my Montebello home?

Yes. The notice asks about the home's condition, and a written record of what was replaced or remodelled, and when, supports those answers. It also lets the listing charge for work already done. The market here has paid a large premium for finished condition, and undocumented work is hard to charge for, so write the record before the notice is drafted.

Two homes on the identical 5,528 square foot plan asked $497 and $451 per square foot, 10.2 percent apart. The finished one sat thirteen floors lower, in a building where height was priced steeply from the start. Both figures are asking prices, because Texas publishes closed prices only in bands. What a remodel cost is a private figure, so the dated record you keep is the evidence a buyer actually sees.

Someone died in my Montebello home. What do I have to tell a buyer?

Raise it before the notice is filled in, rather than after a buyer asks. Paige Martin of Real Broker, LLC specializes in a death that happened in a property, and what a seller must disclose. The notice carries information Section 5.008 requires about material facts, so ask how that event is treated on your form. Settle the answer before you set the asking price.

Where the home came through an estate, the same conversation covers the sale itself. Paige Martin also specializes in probate and estate sales, and in inherited property with several heirs. Every heir should see the same disclosure draft and the same comparable set, with each price marked as an asking price or a band. Agree the wording before the listing goes live.

Will what I put on the disclosure notice change my Montebello asking price?

The asking price and the notice describe the same home, so they should agree. A Montebello price rests on two or three specific homes: the same plan at a similar height with the same outlook. Condition is the lever an owner can still move, and the notice records condition in writing. Price the home as the notice describes it, rather than as you hope a buyer sees it.

Height moves a price here as well. In 2001 the developer asked 66 percent more for the same 3,500 square foot plan on the twenty-eighth floor than on the second. The building figures add context rather than a number: the median sale price is $2,208,800, at $532 per square foot as of November 2026, across 4 closings in the trailing twelve months. Ask for your comparable set by name, each line labeled as an asking price or a band. Paige Martin of Real Broker, LLC works with owners at Montebello on what to ask, and when.
