Texas law on co-owned homes and partition limits

Co-Owned Montebello Homes: Partition Limits, Court-Ordered Transfers and Court Rules

Updated November 2026

What limits does Texas law put on forcing the partition or sale of a co-owned home in Montebello?

In October 2026, Texas's Constitution bars partitioning an inherited homestead among heirs during the surviving spouse's lifetime or homestead use, or while a court-permitted guardian of minor children occupies it.

Which Texas rule limits partition of an inherited Montebello home?

Article 16, Section 52 of the Texas Constitution sets the limit. When a spouse dies, the homestead descends and vests like the deceased's other real property, under the same laws of descent and distribution.

Section 52 then bars partitioning the homestead among the heirs of the deceased in three situations. The first runs for the lifetime of the surviving husband or wife.

The second runs for as long as the survivor may elect to use or occupy the home as a homestead. The third runs for as long as the proper court with jurisdiction permits the guardian of the deceased's minor children to use and occupy it.

The bar speaks to a homestead and to the heirs of the deceased. Whether a particular Montebello home was the homestead is the first question to settle with a Texas attorney.

What can a court order about a co-owned Montebello home?

The Texas State Law Library's family law guide says a decree may order that a house or its mortgage be transferred to one spouse. The order states the outcome, and recording it can take more.

Where the home is in both spouses' names, the same guide says additional paperwork may be needed to complete the transfer. Montebello homes are recorded in Harris County, and any later resale reads that record.

The guide also warns that using a quitclaim deed in Texas can cause problems with the chain of title. Ask a Texas attorney which instrument suits the order.

Timing has a limit as well. The guide gives two years from the date of the final decree to file for enforcement of property division.

Which court rules apply when a Montebello home is in a court case?

The Texas State Law Library's court rules page says the Rules of Civil Procedure govern the proceedings in civil trials. A dispute over a co-owned Montebello home heard as a civil case follows them.

The same page says lower courts often adopt local rules for court proceedings in their jurisdictions. Ask early which court holds the case, so its local rules are read beside the statewide ones.

What does a Montebello home cost each month while a court limit or order is pending?

The building's published assessment rate is $1.05 per square foot per month. A 5,000 square foot home therefore carries $5,250 in assessments each month.

Property tax at the 2026 median rate the market-statistics feed reports for this building adds roughly $3,700 a month on a two million dollar valuation. Insurance and utilities come on top.

Those bills keep arriving whether a partition is barred, a transfer has stalled, or a sale is waiting on both sides. Agree in writing who pays each line.

If the home is sold, plan for the marketing period too. Three closings in the trailing twelve months published one, and they ran 16, 55 and 169 days.

Who prices a court-ordered Montebello sale, and from what record?

Paige Martin of Real Broker, LLC specializes in court-ordered sales, including sales that require both parties to approve.

She starts from the home's own comparable set: the same plan at a similar height with the same outlook. With four homes to each floor in a 98-home tower, that usually means two or three specific homes.

The building figures are context for that set. The median sale price is $2,208,800, at $532 per square foot as of November 2026, across 4 closings in the trailing twelve months.

Texas publishes closed prices only in bands, so every price for a named home is an asking price. Give both parties one list, with each line labeled that way.

Questions & answers

Montebello questions, answered

If two of us own a Montebello home under a survivorship agreement, what happens to a share when one owner dies?

The State Law Library's probate guide says that where property is jointly owned and the owners have signed a survivorship agreement, the surviving owner automatically inherits the deceased owner's share. Both conditions matter: joint ownership and a signed agreement. The guide adds that the agreement may be part of the deed or signed at a later time. Check the recorded deed and any document signed afterwards.

The guide lists this rule on its page for nonprobate property. Read the title to a Montebello home before anyone raises partition or a court-ordered sale. A share that has already passed to the survivor changes who the co-owners are. The deed sits in the Harris County record. Where it carries no survivorship language, ask whether the owners signed an agreement later, and keep a copy with the sale file. Who must approve a sale depends on that answer, so settle it before a price is discussed.

Does a surviving spouse's right to stay in the Montebello home give them title to it?

No. The State Law Library's probate guide says Texas law allows the surviving spouse or minor children to stay in their primary home, even if the property was inherited by another party. The same guide says the right to live in the house does not grant title to property and comes with certain responsibilities. Title stays with whoever inherited the home.

The guide sets this right beside the exemption from creditor claims, on its family protections page. It ties the right to the surviving spouse or minor children, rather than to every heir. At Montebello the responsibilities question has real money attached. The home carries an assessment of $1.05 per square foot each month, plus property tax, insurance and utilities. Which of those the occupant pays is a question for a Texas attorney reading the estate's documents.

Does the surviving spouse have to be living in the Montebello home to keep the right to stay?

Yes, under the State Law Library's probate guide. To qualify, it says, the surviving spouse or children must be using the home as their primary residence. A Montebello home kept as a second residence, or left empty, falls outside that description. Where the residence test is met, the same guide says the right holds even if another party inherited the property.

Settle the residence facts with a Texas attorney before anyone names a price. The constitutional partition bar also turns on homestead use, so the same facts often answer two questions. Gather the records that show where the survivor has lived, and keep them in one file with the home's Montebello documents.

Where do we get the local rules for the court hearing our Montebello case?

Start online, then go to the clerk. The State Law Library's court rules page says that if local rules are not online, contact the district clerk, county clerk, or city clerk for help accessing them. Ask which clerk serves the court that has the case, and request the current version from that office before any filing or hearing.

Keep a copy of the version you used, with the date you obtained it. File it beside the decree or order and the home's Montebello records: the resale certificate, the recorded declaration and the appraisal account. Applying those rules to a particular case is an attorney's work.

When should we order the resale certificate if a court has to approve the Montebello sale?

Order it once a listing date is in view, rather than at the start of a long case. The Montebello association has ten days after an owner's written request to furnish one, and it may charge up to $375. The certificate must have been prepared no earlier than three months before it reaches a buyer, so an early copy can go stale.

The certificate states the home's own periodic assessment, any unpaid amounts due from the seller, and every fee payable when ownership transfers. Give both parties the same copy on the same day. A figure one side has not seen is a figure that side may decline to approve.
